WEA APPLICANT & PARTICIPANT TERMS & CONDITIONS

The Terms and Conditions set out below apply to all applicants submitting their application for the Women Entrepreneur Award (“Award”) and participants selected to participate in the Award. Please read these terms and conditions carefully. By virtue of participating in this Award you hereby agree to these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate.

The Award is being conducted by H2H Events Ltd, hereinafter referred to as the “Awarder”. In the event of any inconsistency between these Terms and Conditions and any terms and conditions printed or displayed on any marketing materials published or broadcasted in any media (such as but not limited to the internet, television, radio, newspaper, magazines etc.) relating to the Award, the terms contained in these Terms and Conditions shall prevail.

DEFINITION

Applicant – An Applicant is someone who applies for the Award by submitting all required documents for the purpose of KYC process carried by the Awarder.

Participant – A Participant is an applicant who has been qualified for the Award after the KYC process and is actively participating in the different phases of the Award.

AWARD PERIOD

The Registration will run from 6th May 2024 up to 20th July 2024. No entries received after midnight on the 20th of July 2024 will be accepted. The Award Period may be extended or curtailed at the discretion of the Awarder.

WHO MAY PARTICIPATE?

  1.  All Applicants of the Award must, at the time of entering the Registration:
    a) be a person and at least 18 (eighteen) years of age
    b) be a citizen and/or resident of the Republic of Mauritius
    c) submit particulars of their company/extract of files (not dating more than one (1) month); and
    d) be residing or be present in Mauritius for the duration of the Award Period, for any live event and for the period during which the Award Ceremony takes place. 
  2. Participation in the Award excludes directors, members, partners, promotional and advertising agents, employees, or consultants of the Awarder, or any third parties involved in the execution of the Award, either directly or indirectly. 
  3. To qualify for the Award, Applicants must submit all the required documents and respond to all the set of applicable criteria.
  4. Applicants must own their business fully (100% shares), or in half (50% shares) or with majority shares.

AWARDER’S RIGHTS AND PERFORMANCE

  1. The Awarder reserves the right, at any time, to verify the validity of applicants (including but not limited to an applicant’s identity, age, place of residence, corporate details) and to reject any applicant who has not complied with these Terms and Conditions. Errors and omissions may not be accepted at the Awarder’s discretion.
  2. The Awarder reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such legal or natural person in advertising or publicity for the Award will not bring the Awarder or any of the Awarder’s associated companies and/or collaborators into public disrepute, contempt, scandal, or ridicule or reflect unfavourably on the Award as determined by Awarder in its sole discretion.
  3. The Awarder reserves the right to amend, modify, change, postpone, suspend, or cancel this Award and any prizes, or any aspect thereof, without notice at any time, for any reason that the Awarder reasonable deems necessary.
  4. The Awarder may refuse to award the prize to a participant if there is suspicion of any irregularities, unethical practices, or fraudulent activities.
  5. The Awarder reserves the right to reject an application if the Applicant uses the Award for political purposes, including but not limited to campaigning, endorsements, or advocating for political candidates or parties.
  6. Failure by the Awarder to enforce any of its rights at any stage does not constitute a waiver of those rights.

     

INDEMNITY

  1. To the full extent permitted by the applicable law, the Applicants and/or participant(s) hereby indemnifies the Awarder, its associated companies (directors, officers, juries, and/or employees) and/or agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the Applicants entrance to the Award.
  2. Applicants agree to indemnify, defend, and hold harmless the Awarder from and against any and all claims, damages, liabilities, costs and expenses arising out of or in connection with any infringement or alleged infringement of any third-party intellectual property rights.

TERMINATION

  1. If the Awarder is required by any law, to alter any aspect of the Award or to terminate the Award as a result of changes in legislation, the Awarder will have the right to terminate this Award with immediate effect. No liability shall lie on the Awarder in favour of any Applicant(s) and/or Participant(s), winner(s) and/or third-party arising from such cancellation, suspension, or termination.
  2. Therefore, the applicant hereby waives any rights which they may have against the Awarder and acknowledge that they will have no recourse or claim of any nature whatsoever against the Awarder, its agents and/or collaborators.

LIABILITY

  1. The Awarder excludes all warranties (express or implied), representations and liabilities regarding this Award (other than for death or personal injury caused by its negligence and/or fraud). Neither the Awarder nor its agents, juries, contractors, or suppliers will have any liability in relation to this Award.
  2. Nothing in this Terms & Conditions limit or exclude the Awarder’s liability for death or personal injury resulting from the Awarder’s negligence, fraud, or fraudulent misrepresentation, or where and to the extent it is otherwise not lawful for the Awarder to exclude or limit the liability concerned.

CONFIDENTIALITY

  1. The Awarder shall hold the Applicant’s proprietary or confidential information in strict confidence and protect such information from unauthorised disclosure, access, or use. The Awarder shall make use of such information only for the purposes related to Participant’s involvement in the Award. Applicants and Participants confidential information remain the sole and exclusive property of the Applicants and Participants respectively.
  2. Proprietary or confidential information shall include, but is not limited to, list of shareholders, directors and beneficial owners, trade secrets, know-how, business methods, business policies, reports, computer retained information or notes, disclosed by the Applicant on this website or in any other way for the purpose of this Award.
  3. The obligations of confidentiality shall not apply to information that:
  4. a) is or becomes generally known to the public by any means other than a breach of the obligations of the Awarder;
  5. b) was previously known to the Awarder or rightly received by the Awarder from a third-party;
  6. c) is required to be disclosed by or to any Regulatory Authority, any auditor, or by judicial or administrative process or otherwise by Applicable Law.
  7. By participating in this Award, participants agrees that the Awarder will make their proprietary or confidential information available in any form to any third-party privy to such information without their further consent or to use such information to fulfil the purposes related to the Award. In the event of illegal use or disclosure by the Awarder of those confidential information, the Applicants and/or Participants may be entitled to equitable relief.
  8. Within one (1) month after the Award, the Awarder shall destroy all such proprietary or confidential information, unless 

PERSONAL DATA PROTECTION

  1. By registering and participating in the Award, the Applicant gives consent to the Awarder to process the Personal Information related to its participation in the Award. Applicant’s personal data shall be processed in accordance with the Privacy Policy which can be found on this website.
  2. During the Award, the Participant authorise the Awarder to process their personal data collected from the participation form on this website and any additional personal information requested for the purpose of their participation in the Award. This data will be shared with third parties including service providers, jury panel, and collaborators, as well as regulatory bodies that may be privy to Participant’s personal data for their participation in the Award.
  3. By participating in this Award, Participant also agrees that their personal information will be used for the purpose of communicating details of the Award as part of the Award’s activities and in furtherance of marketing and promotional activities, during and after the Award Period. However, Participants will have the option to decline or unsubscribe with every marketing communication received.
  4. The Participant hereby expressly agrees and understands that their personal data including names and images will be used by the Awarder for the purposes of marketing and external communications. Images and names will therefore be posted on public domains without further notice or request for consent. The participation in this Award shall be deemed to constitute sufficient, informed and express consent. If Participant rejects to the use of their images or names, they may make such rejection by sending an email to: legal@dmh2h.com
  5. Applicants and Participants personal data will be retained for as long as they remain subscribed. The Awarder will ensure to issue regular communications in this regard. Once the Award has ended and the prizes have been awarded, Participants details will be anonymized, with non-Personal data being used for statistical purposes.
  6. Under the Mauritian Data Protection Act (2017), Data Subjects have the right to object or restrict the use of their personal data, the right to a copy and a right to request further information on the use of their personal data. A request for deletion or restriction on the processing of personal data or any other data subject request may automatically terminate Participation at the sole discretion of the Awarder. Applicants and Participants have the right to make a complaint with the data protection authority.

GENERAL

  1. The onus rests on the Applicants and Participants to check the website for updates to the Terms and Conditions.
  2. The Awarder’s decision is final, and no correspondence will be entered into.
  3. In part or all of any clause of these Terms and Conditions is illegal, invalid or enforceable, 

(i) it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;

 (ii) it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

  1. In the event of any dispute, controversy or claim arising out of, or in connection with these Terms and Conditions, the Applicants and Participants shall attempt to settle such dispute or difference and failing at dispute resolution within a period of 30 days from the date of the request to resolve the matter amicable, the Applicants and Participants agree to submit any claim or despite to the exclusive Jurisdiction of the Courts of the Republic of Mauritius.
  2. This Award is not applicable in conjunction with any other services offered by the Awarder.
  3. The Applicant and/or Participant shall give full credit to the Awarder and/or Award while sharing content from the Award on social media.
